This is a suit to remove a cloud on certain real property described as follows:
"Beginning at a point north 6 degrees east 7.52 chains from the northeast corner of D.L.C. of Davis Shannon, it being claim No. 39, in township 6, south range 2 west; thence north 7 degrees 12 minutes east along the middle of the lane between William Russell and Samuel Simmons 39.94 chains to a stake; thence west 44 chains and 8 links; thence south 7 degrees 48 minutes west 24.40 chains; thence south 71 degrees 42 minutes east 20.16 chains; thence south 10 degrees 15 minutes west 3.67 chains; thence south 77 1/4 degrees east 24.63 chains to the place of beginning, and containing 139 acres, more or less.
"Also, beginning at northeast corner of the above described tract, running thence east 38.81 chains to a post on the range line between ranges 1 and 2 west; thence south along said line 25.15 chains to a post; thence north 86 degrees 9 minutes west 44.51 chains; thence north 9 degrees 15 minutes east 20.46 chains to place of beginning, containing 96.76 acres, more or less.
"Also, commencing at the southwest corner of section 30, township 6 south range 1 west of the Willamette Meridian; thence north 57.21 chains; thence south 88 degrees 21 minutes east 10.88 chains; thence north 2 degrees 9 minutes east 56 chains; thence east 40.21 chains; thence south 45.30 chains; thence west 18.20 chains; thence south 27 degrees west 76.66 chains to place of beginning, containing 292.29 acres, more or less.
"Save and except from the above described 197.70 acres described as follows, to wit:
"Beginning at the southwest corner of the D.L.C. of Isaac Hendrick and wife, being claim No. 39, township 6, south range 1 west and running thence north 65 3/4 degrees east 26.32 chains; thence east 18.20 chains to a corner in southeast boundary of claim No. 40 of Samuel Simmons; thence north 45.30 chains to the northeast corner of claim No. 40; thence west 40.21 chains to the northwest corner of claim No. 40; section *Page 128 19; thence south 2 degrees 9 minutes west 56 chains to place of beginning, in section 30, township and range as above mentioned.
"There being in all of said premises 330.35 acres of land, and all situated in Marion County, Oregon, and being subject to all public road easements thereon as shown by deed in volume 52, page 104, Marion County, Oregon."
The plaintiff and respondent is a daughter of Isaac Durbin, deceased.
On the 19th day of May, 1906, Isaac Durbin executed his last will and testament wherein he devised unto plaintiff and respondent an interest in and to said real property, the language of such devise being as follows:
"Fourth, to my daughter, Lela Jerman, and the heirs of her body only, and subject to the life estate therein of my wife, Olive Durbin, I hereby grant, will and devise the following described real premises, to-wit: What is known as the Sappingfield tract of land in Marion County, Oregon, as more particularly described in a deed of conveyance of date, August 29, 1892, and recorded in Vol. 52, page 104 of Marion County records of deeds, on August 30, 1892, the said lands and premises to be taken by my said daughter, Lela Jerman, after the death of my said wife, and to be held and enjoyed by her during the remainder of her natural life, and upon her death to descend to the heirs of her body only."
Olive Durbin is dead. Edward D. Jerman and Paul Jerman are sons of said Lela Jerman and were living when said will of Isaac Durbin was executed, and are now living. Paul Jerman has two daughters and Edward D. Jerman has one child. Edward D. Jerman is also referred to as E.D. Jerman.
The defendant and appellant, Merze O. Nelson, is the mortgagee under the name of Merze O. Herrick in *Page 129 that certain mortgage which was executed by Edward D. Jerman under date of June 6, 1923, and recorded on the 13th day of June, 1923, in volume 20, page 51, Record of Mortgages for Marion county, Oregon. This mortgage purports to convey unto Merze O. Herrick "all of his (Edward D. Jerman's) right, title and interest in and to" the real property involved in this suit.
The answer of defendant and appellant alleges, and the record discloses, that upon the 18th day of September, 1923, a judgment was obtained in the circuit court in and for Multnomah county, Oregon, in favor of defendant and appellant and against said Edward D. Jerman in the sum of $428.26, with interest thereon at the rate of 7 per cent per annum from August 21, 1923, for $75 attorney's fees, and costs and disbursements. That at the time of the institution of the action wherein said judgment was rendered, a writ of attachment was issued, directed to the sheriff of Marion county, Oregon, and in accordance therewith such sheriff attached all the right, title and interest of said E.D. Jerman in and to the real property described in plaintiff's amended complaint, and that on the third day of November, 1923, the interest of E.D. Jerman in said real property was sold to defendant upon execution issued to enforce said judgment. That such sale was duly confirmed and after the expiration of one year a sheriff's deed was executed and delivered to defendant conveying said E.D. Jerman's interest in said property to defendant. This deed is recorded in volume 202 at page 577 of the Deed Records in and for Marion county, Oregon.
A deed dated January 2, 1926, was executed by E.D. Jerman and Paul Jerman to plaintiff herein, Lela Jerman, purporting to convey to her, the said Lela Jerman, all the right, title and interest of said Paul *Page 130 Jerman and E.D. Jerman in and to said real property. This deed is recorded in the office of the county recorder in and for Marion county, Oregon, at page 349 of volume 188 of the Record of Deeds in said county.
Plaintiff's amended complaint, in effect, recites that the mortgage dated June 6, 1923, and executed by Edward D. Jerman, wherein defendant is the grantee, casts a cloud upon plaintiff's title, which plaintiff seeks to have removed.
Defendant's answer and cross-complaint, in effect, recites that the deed last mentioned constituted a cloud upon her interest in and to the real property involved herein and defendant asks that plaintiff be decreed to have a life estate in said property; that defendant's mortgage be decreed to be a first prior lien in the amount of the same upon the undivided one-half interest in the said real property subject only to the life estate of plaintiff herein; that defendant be decreed to be the owner in fee simple of an undivided one-half interest in and to the said premises subject to plaintiff's life estate and subject also to the lien of defendant's said mortgage; that defendant's mortgage and defendant's legal title be decreed not to merge, and for her costs and disbursements.
The trial court made findings of fact, among other things, to the effect that plaintiff is the owner in fee simple of said real property; that the mortgage and execution sale above mentioned casts a cloud upon plaintiff's title; and pursuant to its findings of fact and conclusions of law based thereon said court entered a decree granting plaintiff the relief prayed for in her amended complaint. *Page 131 The questions, which, when decided, will determine the rights of the parties in this case, with respect to the real estate involved, are as follows:
First. What estate was devised to plaintiff and respondent by the will of her father, Isaac Durbin?
Second. What interest, if any, passed to her by the deed from her sons, Edward D. Jerman and Paul Jerman?
Third. What, if any, estate does she have by operation of law?
Fourth. What interest, if any, passed to defendant and appellant by the mortgage of E.D. Jerman to her?
Fifth. What interest, if any, was transferred and conveyed to defendant and appellant by the attachment, judgment, sale upon execution, confirmation thereof, and the execution and delivery of the sheriff's deed?
In this court, it was practically conceded by plaintiff and respondent, and, at all times, it has been urged by defendant and appellant that the interest devised by the will, in question, to plaintiff was that of an estate during her natural life; and we so hold.
To answer the second, fourth and fifth of the above questions, it is necessary to determine the nature of the estate of Edward D. Jerman as a prospective heir of the body of plaintiff, if any, passing by virtue of the testamentary devise quoted in the statement of facts.
In the case of Jerman v. Jerman,
It should be borne in mind that this case is one wherein the interest under consideration was devised to the heirs of the body of Lela Jerman, and it is not to be confused with those cases wherein the devise is to children or grandchildren, or in terms supported by context implying that children or grandchildren, or other existing relatives, were the beneficiaries.
Defendant and appellant urges that, by the terms of Or. L., § 10119, a devise, for the life of a person, and after his death to the heirs of such person's body, creates an estate in fee simple in those who are the heirs presumptive of the life tenant subject only to such tenant's life estate. We do not so construe that section of the statute. It reads as follows:
"If any person by last will devise any real estate to any person for the term of such person's life, and after his death, to his or her children or heirs, or right heirs in fee, such devise shall vest an estate for life only in such devisee, and remainder in fee simple in such children."
Section 550, R.S. 1919 of Missouri is almost identical with the above-quoted section of the Oregon statutes. In Green v. Irvin,
Section 2345 of the Kentucky statutes provides:
"If any estate shall be given by deed or will to any person for his life, and after his death to his heirs, or the heirs of his body, or his issue or descendants, the same shall be construed to be an estate for life only in such person, and a remainder in fee simple in his heirs, or the heirs of his body, or his issue or descendants."
The supreme court of Kentucky, nevertheless, held that:
"If the devise had been to [X] for life, remainder to her heirs, the remainder would have been contingent, unless it appeared that the word ``heirs' meant children, for it would have been impossible to ascertain who her heirs were until her death."Campbell v. Hinton,
Section 10578, General Code of Ohio, reads as follows:
"When lands, tenements, or hereditaments are given by will to a person for his life, and after his death to his heirs in fee, or by words to that effect, the conveyance shall vest an estate for life only in such first taker, and a remainder in fee simple in his heirs."
The appellate court of Ohio quotes this statute and declares that, where the estate is devised to M.P. without reservation for her life, and after her death the remainder was given to her bodily heirs in fee simple, the bodily heirs, for whom the remainder was intended, are those who shall be such bodily heirs at the decease of the person holding the life estate, and that in such case the remainder is contingent and the fee vests when the contingency ceases: Pollock v. Brayton,
It is true that the cases of Winchell v. Winchell,
Treating the interest of Edward D. Jerman as a contingent remainder, it becomes necessary to determine whether or not the same is alienable.
Under the common law, contingent remainders, of the class to which the one in the case at bar belongs, were not alienable to a stranger to the title. Some courts in sister jurisdictions adhere to that rule: DuBois v. Judy,
This court, however, is committed to the doctrine that such contingent remainders are vendible: Love v. Walker,
Applying this principle to the case at bar, the interest in the premises in controversy of Edward D. Jerman, as contingent remainderman, was mortgaged to defendant; and later transferred to defendant by sheriff's deed, pursuant to an execution and a sale thereupon prior to the execution of the deed by Edward D. Jerman and Paul Jerman to their mother, the plaintiff herein. Plaintiff's deed from Edward D. Jerman and Paul Jerman, being subsequent to defendant's deed, passed no interest whatever from Edward D. Jerman to plaintiff.
No interest in said premises has passed or can pass to plaintiff by operation of law for the reason that, *Page 135 under the terms of the will in question, the reversion, if any, depends upon plaintiff's death without heirs of her body. By operation of law, therefore, the heirs of Isaac Durbin, who survive plaintiff, are the reversioners; and not plaintiff, herself. The estate of these reversioners is expectant upon the death of plaintiff without heirs of her body.
The defendant desires the decree to declare that her interest as mortgagee and her interest as grantee under the sheriff's deed are not merged.
"In equity mergers are considered odious, and are much less favored than at law, and are made to depend upon the intention and interest of the party. It is only in those cases where it is perfectly indifferent to the party in whom the interests had united whether the charge or term should or should not subsist, that in equity the term is merged": Watson v. Dundee M T.I.Co.,
The decree of the lower court should be and is hereby modified in that instead of declaring plaintiff and respondent to be the owner in fee simple of said property, and that defendant has no estate or interest therein, it is ordered, adjudged and decreed that the plaintiff and respondent herein is the owner of an estate during her natural life, in possession of and entitled to possession of said real property; that defendant's mortgage, appearing of record at page 51 of volume 20 of the Record of Mortgages in and for Marion county, Oregon, constitutes a lien upon the interest of said Edward D. Jerman as contingent remainderman, and that the sheriff's deed to defendant recorded in volume 202, at page 577, of the Deed Records in Marion county, Oregon, evidences the transfer of the interest of said Edward D. Jerman, as such contingent remainderman, to defendant and that defendant's *Page 136 interest as mortgagee in said mortgage and as grantee in said sheriff's deed are not merged; that plaintiff's deed from Paul Jerman and Edward D. Jerman, recorded at page 349 of volume 188 of the Record of Deeds in and for Marion county, Oregon, in so far as it purports to transfer unto plaintiff the interest in said premises of Edward D. Jerman, as a prospective heir of the body of plaintiff, is, and is hereby declared to be a cloud upon defendant's interest as owner of said contingent remainder, which said cloud is hereby removed; that the decree is without prejudice to any heir of the body of Lela Jerman other than Edward D. Jerman; and inasmuch as both parties, plaintiff and defendant, have urged and insisted upon untenable and unwarranted claims to the premises in dispute, it is hereby ordered that neither party shall recover costs or disbursements either in this court or in the circuit court.
