The same objections to the charge of the presiding Judge arise in this case as in the case of Curlee v. Railway Co. (S.C.),115 S.E., 628 (pending), and for the reasons given in my dissent in that case I think that the seventh and eighth exceptions, which will be reported, should be sustained.
