THE STATE OF TEXAS, Appellee. ____________________________________________________________ On appeal from the 105th District Court of Kleberg County, Texas. ____________________________________________________________ MEMORANDUM OPINION Before Justices Rodriguez, Longoria, and Hinojosa Memorandum Opinion by Justice Longoria Counsel for appellant filed a motion to dismiss the appeal. The motion states that appellant requests the appeal be dismissed through a pleading filed with the trial court and contained in a supplemental clerk’s record. A supplemental clerk’s record includes appellant’s signed “Intention of Defendant Regarding Appeal” stating that he does not intend to pursue the appeal of his case and would like it dismissed. We find the motion and document together meet the requirement of Texas Rule of Appellate Procedure 42.2(a) that appellant and his attorney must sign a written motion to dismiss the appeal. See TEX. R. APP. P. 42.2(a). Without passing on the merits of the case, we grant the motion to dismiss pursuant to Texas Rule of Appellate Procedure 42.2(a) and dismiss the appeal.
