McFadden v. State

Appellant's case is one which turns solely on the facts. We are not authorized to reverse when the evidence supports the verdict. In our original opinion we mentioned that a witness testified that on the occasion under investigation he bought eighteen pints of whisky, paying one dollar per pint. The witness also said that he had bought whisky by the gallon from appellant for which he paid $5.00 per gallon.

The motion for rehearing is overruled.
